The following email was received alerting us to some scheduled maintenance that RightFiber will be doing in our neighborhood. Updated Statement on the Installation of Solar Panels in River Oaks

Because many property owners in River Oaks have expressed an interest in solar panels, the Board wants to remind members of the River Oaks Property Owners Association that there is a stated policy on the installation of solar panels, issued in December 2021. It reads as follows: The Board has received some inquiries from residents who are thinking about installing solar panels on their property in the River Oaks Addition. The Board encourages residents to check with the Searcy city code office regarding city guidelines for solar panels (Ordinance 2021-16 at https://www.cityofsearcy.org/ordinances-resolutions ) and to consult the POA covenants prior to making modifications to their property, especially the guidelines relating to modifications visible from the street. There has been considerable interest in and discussion about short-term rental properties in the River Oaks area. The city of Searcy has recently passed an ordinance (Ordinance No. 2022-22) addressing short-term rentals in Searcy, and the Board of the River Oaks Property Owners Association, Inc., intends to support and adhere to that policy statement, which can be viewed online at https://www.cityofsearcy.org/ordinances-resolutions . Recognizing the tension between the rights of landowners and adjacent landowners over short-term rentals, the city went through a lengthy vetting process before approving Ordinance No.2022-22, which is designed to be enforceable, equitable and affordable. The Board of the River Oaks Property Owners Association commends the property owners for their cooperation in paying their assessments and supporting the Board’s work. The latest report from the treasurer shows that, over the past four years, 75% of the property owners have paid their assessments in full, thus allowing the Board to maintain its budget and to accrue sufficient funds to have the contingency that they have been planning for. Annual Assessment : Based on these facts, although authorized to collect an annual assessment of $48.00, the Board has approved discounting the annual assessment for 2023 to $24.00 per lot . Assuming continued support at the same level from the property owners, the collection of the reduced assessment will meet the projected budget and fund the activities being planned by the Board. He reported that the mayor and city engineer have been informed about the problems in River Oaks and they acknowledge that the problem is city-wide. Roberson added that Golf Course drive has the same issue at the Abrams property. The Board recommended that POA be supportive of the residents who have experienced drainage issues. The issue is whether, according to the bylaws, the Board members need to offer an election or whether they can simply make the appointment as they have done in the past. When a resident has a building project that will involve the appearance of the outside of their home or involves any other structure on their lot, then the Architectural Committee would appreciate a call from them. The contact allows us to ensure compliance with POA covenants and possibly even city codes. The contact also provides an opportunity for the committee to share information on materials or contractors as well as gain information that may help other residents. Rather than being a discussion of what can or can’t be done, the committee’s goal is that each meeting should be positive and helpful, designed to benefit the residents of the POA. I believe many River Oaks property owners are uninformed or misinformed about the River Oaks POA. I have purchased land and built about a dozen homes in River Oaks, from the very first phase through three fourths of the development. For one, the POA did not run out in the 80s. I built one of the first homes in the subdivision in 1986. The lot had Covenants and Restrictions (C&R) to run for, I believe, 40 years. All plans had to be approved by the POA, who happened to be the developer. The builder and original home owner were subject to the C&R, as well as subsequent home owners for the term, unless amended by vote of the River Oaks Property owners. From the time the development started until the final phases was a period of over 25 years, and each phase has its own C&R from the time the development plans were filed at the courthouse.
